DA: Man Gets 12 Years for Crash that Killed Father of Three

Brian Daly sentenced in crash that killed Christopher DeCrescito, reports NCDA.

A Valley Stream man was sentenced Monday for his involvement in a crash that killed a Franklin Square father of three last year, according to the Nassau County District Attorney's office.

Brian Daly, 26, was ordered to serve 12 years in prison without parole and will spend five years under post-release supervision, said the DA. The sentencing came down after Daly pleaded guilty in March to first-degree depraved indifference assault, second-degree manslaughter, third-degree criminal possession of a controlled substance, and driving while intoxicated.

Daly was drunk and high on cocaine at the wheel of his car when he slammed into Christopher DeCrescito in February 2013, said the DA. Daly was driving at 70 miles per hour in a 30 mile-per-hour zone and had run several red lights before broadsiding DeCrescito, said the DA.

Nassau County Police said said he was found with more than a half-ounce of cocaine at the time.

DeCrescito left behind a wife and three children.

“Mrs. DeCrescito’s statement in court today said it all when she said that her husband ‘died a terrible death because of Brian Daly’s dangerous conduct and complete disregard for anything and anyone besides himself’,” said DA Kathleen Rice. “Nothing will give the DeCrescito family closure, but today’s prison sentence ensures that the defendant will pay for his crimes for a significant length of time. I hope that other drivers will learn from this tragedy.”

Daly waived his right to appeal as part of his plea, said the DA.
